False dilemma really - age checks for minors is mass surveillance no matter how you look at it. It might be mass surveillance motivated by a desire to keep children safe (ha!) but that's still mass surveillance, and the wonderful thing about mass surveillance is that you can use it for loads of different things that weren't the original/intended/supposed purpose.
Yes. Age verification laws are another arm of the mass surveillance state, it was never about protecting children from objectionable content online.
Most closed-source operating systems have OS-level tracking built in that cannot be removed by the user. If you're concerned about tracking and your device's attack surface, install a Linux distro.

This isn't a conspiracy theory. Age checks are identity checks, Discord back in February/March was going to add age verification, but received major backlash as the company Persona was tied to Plantir. Plantir is a company known for mass surveillance and was caught working with ICE. Discord also got 70k IDs leaked recently from age checks. Which proves that they don't delete the ID once verified.
Age verification will not keep children safe, in fact it will make the internet more dangerous for children. Parents will just verify just to shut up their kid, so when there's a data breach, the kid's address could be leaked and put into a service sold to pedophiles to stalk children. Age verification will also funnel children into more dangerous platforms, a new business could rise from this that sell darknet phones directly to children from China or some other country, that give children unrestricted and easy access to the darknet. While I support TOR, TOR is getting faster and more accessible, meaning that theses new age check laws could onboard more children to the darknet as a consequence.

You need a Google Pixel, Graphene OS is very picky on hardware. Right now the only phones that are compatible are Google Pixels. You could look into Lineage or Post market OS, but these Oses do not have as robust privacy protections as Graphene OS.
